| Community-based Justice and the Protection of Women's Rights: A Case of Woman Pursuing Separation in the Republic of China |

Abstract The protection of women's rights is not only a task for legislation but also must be implemented in the administration of justice. How to apply laws to protect women's rights is even critically important. In a case of woman pursuing separation in the Republic of China, the "Civil Code of the Republic of China" did not recognize separation and in face of tradition of civil law, the parties could not assume the right of litigation in pursuit of separation. However, the judge of the case upheld the idea of community-based justice and a social consensus of protecting women's rights in the trial, gave woman the right to pursue separation and preferential treatment in arrangements of rights and obligations after her judicial separation.
